WHAT IS THIS SHIPPING AND DELIVERY POLICY?
This Shipping and Delivery Policy (“Policy”), together with the terms of use , describes MDWClan’s policies and procedures towards shipping and delivery of the Products purchased on the Website. MDWCLAN makes all commercially reasonable endeavours to ensure that the Products are delivered to User in a timely fashion.
User(s) are required to peruse and understand the terms of this Policy. If you do not agree to the terms contained in this Policy, you are advised not to accept the Terms of Use and the Policy and may forthwith leave and stop using the Website. The terms contained in this Policy shall be accepted without modification and accordingly, you agree to be bound by the terms contained herein.
TERMS OF DELIVERY
- We partner with third party logistic service providers in order to effectuate Products delivery to User(s) (“Logistic Partners”). Details of the Logistic Partner who will be processing the delivery of the purchased Products will be provided to the User upon the purchased Product being handed over to the Logistic Partner by us. The User will also be provided with an approximate days of delivery of the purchased Products on the order confirmation page of the Website. We may also effectuate Product delivery to User on our own without engaging Logistic Partners.
- While we aim to provide our services through the Website and ensure the delivery of our Products all across India, currently, we have a select list of areas where delivery can be undertaken. At the time of placing an order for purchase of Products on the Website, User(s) are required to check the delivery options appearing at the checkout and confirm if deliveries can be carried out in their areas. If the area where the User wishes that the purchased Products be delivered is not within our recognised delivery network, we will not be able to process the order further.
- Prior to making payments on the Website for the purchase of Products, the User will be prompted to provide a shipping address. While entering shipping address details, the User should ensure to provide correct, complete and accurate information along with sufficient landmarks in order to aid identification of the address. Any failure in delivering the purchased Products arising out of the User’s failure to provide correct, complete and accurate information shall not hold us liable at any point in time.
- A maximum of 3 (three) attempts shall be made to deliver purchased Products to the User. Should the User continue to remain unavailable after 3 (three) attempts, we reserve the right to cancel the order pertaining to the purchased Products at our sole discretion. While we shall make reasonable endeavours in ensuring that purchased Products are delivered to the User in a timely manner, delivery may be delayed on account of:
- (i) logistical issues beyond MDWCLAN’s control;
- (ii) unsuitable weather conditions;
- (iii) political disruptions, strikes, employee-lockouts, etc.;
- (iv) acts of god such as floods, earthquakes, epidemic, pandemic etc.; and
- (v) other unforeseen circumstances.
- In such events of delay, we shall make reasonable attempt at proactively intimating the User by writing to the User on his/her registered email account and/or mobile number (as provided to MDWCLAN). MDWCLAN disclaims all liabilities that may arise on account of our failure to intimate the User of anticipated delays in the delivery of purchased Products on the Website. Further, we shall be under no obligation to compensate the User for any mental agony or any tortuous claim that may otherwise arise on account of a delay in the shipment and delivery or use of the purchased Products.
- If your order includes several Products, they may be shipped separately and at different times, so that we can deliver your purchased Products to you as efficiently as possible. Products which are shipped from the same location may be grouped together. Our shipping confirmation email will let you know how much of your order has been shipped.
- We, as an internal process, undertake multiple efforts to carefully ensure that our delivery executives and the individuals employed by our Logistic Partners are individuals with the highest regard for ethics and integrity. However, it is not possible for us to ensure that our own delivery executives or employees of our Logistic Partners behave in a fashion that exudes thorough professionalism, competence and good mannerism. It is expressly clarified that any ill-mannerism, impoliteness, discourtesy or offensiveness shown by our delivery executives or by the employees of the Logistic Partners is beyond our control and any issue arising between a User and our delivery executive or an employee of the Logistic Provider will have to be resolved by the User, independently.
- Upon the successful placing of an order on the Website and after we have successfully handed over the purchased Products to our Logistic Partner, the User will receive a unique tracking identity number, which will enable the User in tracking the status of delivery of the purchased Products. The User may use the tracking identity number on the website and/or the mobile application of the Logistic Partner to check the whereabouts of the purchased Products and the estimated time of its delivery. We shall make reasonable attempts in ensuring that the tracking status of the purchased Products is updated in a timely manner. However, we do not guarantee the accuracy of the tracking status since it is updated on a real-time basis and is subject to inconsistencies arising out of time-lags in updating the information and other technicalities beyond our control.
- We reserve the right to charge shipping charges on Products of a value of lower than a specified amount and/or on Products, the payment for which is made by any online/offline mode of payment. If charged, such charges shall not be refunded to the User on cancellations or returns that are made after the shipping of the purchased Products. In case of a Product having a defect at the time of delivery (for reasons attributable to, and accepted by us after due verification at our sole discretion), we will process a replacement for the Product to the customer, after intimating the customer for the same. Title and risk of loss for all purchased Products shall pass onto the User upon the delivery of the purchased Products to the User.
TRACKING YOUR SHIPMENT
There are three easy ways to track your order:
- a. Click on the ‘Order Status/ Track order’ link on the footer of each page.
- b. Our registration is entirely mobile OTP based, User should log in to ‘My Account’ and go to the ‘My Orders’ section. From there you will be able to choose which order you would like to view, and you will have an option to track the order.
- c. You will receive a shipping confirmation email when all or part of your order is shipped. The email will include the tracking number.

Replacement Terms
Replacement of purchased Products shall be carried out by our reverse-logistics partners or our own delivery executives. Further details on how users may process returning of purchased products have been set out under the policy below.
M/s Modern Day Warrior Clan, having its registered office at B-131 Ground Floor, Vasant Kunj Enclave, New Delhi – 110070, India (“MDWCLAN”, “we”, “us” or “our”) is managing and operating the website www.mdwclan.com (“Website”), through which it inter alia facilitates the sale of premium travel bags, overnighters, backpacks, handbags and such other products sold under the brand name ‘MDWCLAN’ (“Product”) to the users of the Website (“User” or “you” or “your”).
RETURN, REFUND AND CANCELLATION
- This Return, Refund and Cancellation Policy (“Policy”),together with the Terms of Use sets out MDWCLAN’s procedures and policies in accepting: (a) Product cancellations before the Product is delivered to a User; or (b) Product returns, once a Product has been delivered to a User after purchase from the Website. Any return or cancellation of Product by User shall be governed by and subject to the terms and conditions set out under this Policy.
- By agreeing to use the Website and/or initiating a request for purchase of Product(s) on the Website, you agree to be bound by the terms contained in this Policy without modification. If you do not agree to the terms contained in this Policy, you are advised not to transact on the Website. Please note that, we may from time to time change the terms of the Policy that govern your return, refund or cancellation of an order for the Product(s) purchased through the Website without prior notification. Any time you wish to use the Website, please check the Policy to ensure you understand the terms and conditions that apply at that time.
TERMS FOR RETURN, REFUND AND CANCELLATION
- If you are unsatisfied/dissatisfied with the Product purchased from the Website, we would want to correct the problem. You may initiate replacement of Product(s) that are unsatisfactory/dissatisfactory within a period of 7 (fourteen) days from the date of receipt of such Product(s) for a replacement. We follow a ‘7 days no questions asked’ replacement policy. Note that the Product to be in unused condition, to be eligible for return. All we require if you wish to return the Product is to pack the Product in the original box along with all original paperwork, original tags, parts, accessories and the original invoice.
- Kindly share the unpacking video in case you want to replace the product. It is mandatory to share the video, without which the replacement will not be considered in any condition.
- Any Products which are tagged/marked as non-returnable on the website or on the Product itself, are non-returnable in nature. No returns under any circumstances will be allowed for such products.
- If any products are customised as per specific requirements from the customer at the time of purchase, such products are non-returnable.
- Product purchased during ‘end of season sale’, ‘mid-season sale’ or any other offer, promotion or sale, by whatever name called, are non-cancellable and non-refundable.
- Products purchased on the Website cannot be exchanged or returned in any of the offline stores.
- If you have received a damaged or defective Product, you may return it within 7 days from the date of receipt of such Product(s) for a replacement, provided you have raised a request to us over email [email protected] or through call +91 8882126804 , within 48 (forty eight) hours of receiving the Product. The Unpacking video of the product is mandatory and must be shared with the request on email. We cannot entertain any request/complaint raised by you, post 48 (forty eight) hours of receipt of the Product. Upon receipt of such request from you, we may replace the damaged or defective Product with the same or similar Product and refund as agreed mutually, the purchase price of the product, if the same product is not available with us.
- While raising a request for replacement on the Website, the User shall have the option to seek a refund of the monies paid by him/her towards the purchase of the Product. The User will be required to produce a copy of the original invoice at the time of placing a request for return of Products. The User shall ensure that the Product(s) being returned comply with the conditions set out under this Policy and are, among other conditions, unused, unwashed, with price tags intact, all packaging material undamaged and unused. Such returned Product(s) should be unused and should not carry scratches, stains, dirt, sweat, detergent, or body odour. MDWCLAN reserves the right to alter, revise or modify this Policy at any time without having to serve a prior notice on the User.
- If a User has purchased Product which forms a part of a package of other Products, or if the Product forms a part of a promotional package (collectively, the “Bundled Package”), the User shall be required to return all the Product that form a part of the Bundled Package for MDWCLAN to process refunds. For explicatory purposes, if the User has purchased a suitcase and a travel bag as 1 (one) Product in a promotional package, the User will be required to return both the Products and will not be permitted to return either only the suitcase or only the travel bag from the Bundled Package. It is hereby clarified that if the Bundled Package consists of any non-returnable Product along with other Products, the User shall return all other Products except the non-returnable Products. If you intend to return a Product which either forms part of a package of other Product(s) or which has been received as a promotional package, you will be required to return all the Product(s) that form part of the Bundled Package.
- Return of or replacement for purchased Products shall not be entertained by MDWCLAN if:
- the Product is not marked as “return accepted” on the Product;
- the Product has been washed, stained, bruised, scratched etc;
- the price tags, brand tags, box, original packaging material, and accompanying accessories have been damaged or discarded by the User;
- the serial number/IMEI number/bar code of the Product or any other identification tags or numbers, as applicable, does not match MDWCLAN’s records;
- the accessories delivered with the Product are not returned along with the Product, in an undamaged condition;
- there are any dents, scratches, tears or any other damage to the Products or any part thereof;
- the gifts accompanying the purchased Product have not been returned, or upon being returned, show signs of being used, washed, or defect;
- the returned Products are fake or counterfeit or damaged;
- MDWCLAN is satisfied that the Product has been rendered defective or unusable; or
- the Product(s) is not purchased through the MDWCLAN Website (www.mdwclan.com).
- the User in any way breaches this Policy.
- In the event a User returns a Product that is not accompanied by the accessories, gifts or other items originally bundled with such Product, MDWCLAN shall have the right, exercisable at its sole discretion, to (i) (a) refuse to accept the return of such Product, or (b) process any refund thereof, or (ii) deduct the amount payable in respect of such items from the amount of refund such User is entitled to.
- MDWCLAN shall initiate a process of refund of the monies paid by the User towards purchase of a Product, if upon conducting quality checks, it is satisfied that the Product being returned entitles the User to a refund as per the policy. It is further clarified that MDWCLAN shall not be required to make any refund or return the Product that it deems ineligible for a refund or return based on such quality checks.
- It is expressly clarified that the refund entitled to by a User shall not include monies paid towards shipping charges or any other such charges applicable from time to time, except in case of a Product having a defect at the time of delivery (for reasons attributable to, and accepted by MDWCLAN after due verification at its sole discretion).
- MDWCLAN shall make all reasonable attempts to keep the User apprised of the status of refund through updates shared on the User’s registered mobile number and email address. MDWCLAN disclaims all liabilities that may arise on account of its failure to keep the User apprised of the status of the refund.
- If the request for refund is undisputed by MDWCLAN, the refund should reflect in the User’s bank account within such reasonable time (subject to the policies of the User’s bank in case of bank account/credit card refunds) from the date on which MDWCLAN initiates the refund.
- Where a User had opted for cash on delivery option for payment towards the purchased Products, MDWCLAN shall process all refunds into User’s valid bank accounts, if details of such accounts are provided by the User to MDWCLAN at the time of refund. Further, should the User have used more than 1 (one) payment option for the purchase of Products on the Website, MDWCLAN shall process all refunds through a payment option (as defined under the Fees and Payments Policy ) to the original source account, to process such refunds.
- Subject to the terms of this Policy, MDWCLAN offers User an easy return/replacement / refund policy. MDWCLAN also accepts partial returns wherein User can raise a return request for one or all Products except in case of Bundled Package.
- The process for initiating and raising a return / refund request is as below:
- Please write an e-mail (within 48 hours of purchase) requesting return/refund with a clear reason to [email protected] . Attach the original invoice with the email. Unpacking video is mandatory and must be submitted with the request.
- Return of purchased Products are facilitated through MDWCLAN’s reverse-logistics partners. Upon a User making a request for return of Product on the Website and the same being duly acknowledged by MDWCLAN, MDWCLAN’s reverse-logistics partners shall get in touch with the User in order to collect the purchased Products from the User and delivering it to MDWCLAN. At the time of handing over the Product, you will have to share with our reverse-logistics partner, the unique tracking number that was shared by us at the time of initiating return request. While MDWCLAN has made reasonable endeavours to ensure delivery and pick-ups across multiple locations in India, currently, MDWCLAN has a select list of areas where deliveries and collection can be undertaken by its reverse-logistics partners. In events where MDWCLAN is unable to facilitate a pick-up of the purchased Product for return from the User, the User is required to self-ship the Product to MDWCLAN’s shipping warehouse, the address for which will be intimated to the User upon the User placing such request for return.. Upon self-shipping the Product to MDWCLAN’s warehouse, the User shall be required to scan the courier/postal receipt to [email protected] for MDWCLAN’s records. The aforesaid return by self-shipping the Products is subject to the returned Products passing quality check at MDWCLAN’s returns desk/warehouse.
- In the event where the User claims to have self-shipped the Product in accordance with the process set out in paragraph above and MDWCLAN does not receive the returned Product or the package containing such Product is empty, the User shall be required to submit the ‘proof of delivery’ received from the courier/postal agency to MDWCLAN to prove his/her claim of return of Product through self-shipment to MDWCLAN. It is specifically clarified that any refunds shall be processed by MDWCLAN only upon it receiving the returned Products and concluding required quality checks or receiving the ‘proof of delivery’ from the User, as the case may be.
Cancellation of Product
Products which are purchased under Flash sale are non-cancellable.
Cancellation before dispatch
User is permitted to fully or partially cancel orders prior to its dispatch from MDWCLAN
- • Upon successfully placing an order on the Website and after MDWCLAN has successfully handed over the Product(s) to its logistic partner, the User will receive a unique tracking identity number, which will enable the User in tracking the status of delivery of the purchased Products.
- • Prior to the dispatch of the purchased Products, should the User decide to cancel the purchase, the User can do so by referencing the unique tracking identity number or order number received by the User and requesting MDWCLAN to process a cancellation by sending an email to [email protected] or through call +91 8882126804
- • Refund, in all events of cancellation prior to the dispatch of the purchased Products, MDWCLAN shall initiate refunds within such reasonable time from the date on which it received the request from the User.
- • In case of cash on delivery (which is limited upto Rs. 5,000/-), the refund will reflect in the User’s bank account within such reasonable time (subject to the policies of the User’s bank in case of bank account/credit card refunds) from the date on which MDWCLAN initiates the refund. All refunds shall be subject to applicable charges as may be deducted by the User’s bank
- • In case of payment made through prepaid mode through any channel, the refund will be made to the original mode of payment. All refunds shall be subject to applicable charges as may be deducted by the User’s bank.
Cancellation after dispatch
We do not accept post-dispatch cancellation of orders or any returns for reasons not mentioned in this policy.
